These Sales Terms and Conditions govern the offer and sale of products to consumers through the website www.caffemilani.it (hereinafter the “Site”), owned by MilaniSpA. These terms are formulated and provided in compliance with the provisions of Legislative Decree 6 September 2005 n.2016 (known as the “Consumer Code”) and any other applicable law related to electronic commerce. 1. PARTIES OF THE CONTRACT – COMMERCIAL POLICY

The parties to the contract are:
• Milani Spa, located in Lipomo, Via Provinciale 811, registered with the Chamber of Commerce of Como, VAT number 00809790132,
• Customer: the end consumer or the individual acting for purposes unrelated to their business or professional activity.

2. APPLICATION AND MODIFICATIONS TO SALES TERMS

By placing an order in the provided manner, the Customer declares to have read all the information provided during the purchase process and fully accepts the Terms and Conditions and Privacy and Cookie Policy. Milani Spa reserves the right to change the General Sales Terms by communicating it on this page. The applicable General Sales Terms are those in force at the time of placing the order. Milani Spa reserves the right to modify the general sales terms at any time by publishing a new version.

3. PRODUCT FEATURES AND PRICES

MilaniSpA sells exclusively products distinguished by its own trademarks on the Site. The essential features of the products are presented on the Site within each product sheet. Products are sold at the price indicated on the Site at the time of the Purchase Order. Product prices may be subject to changes. Please check the final selling price before confirming the purchase. Prices on the Site are inclusive of VAT and, unless expressly indicated, do not include any additional shipping costs, which, if applicable, are communicated to the Customer through specific indications on the Site and specifically recalled during the purchase process.

4. ORDERING PROCEDURES

To purchase one or more products on the Site, the Customer must electronically fill out and submit the respective Purchase Order to Milani Spa, following the instructions provided during the purchase process. All phases of the purchase process are clearly described on the Site pages. The Purchase Order, displayed in its entirety immediately before the conclusion of the contract and in any case before making any payment, provides summary information about the essential characteristics of each ordered product, the price (including all applicable taxes or duties), and any shipping costs. By transmitting the Purchase Order electronically, the Customer unconditionally accepts and undertakes to observe these Sales Terms in relations with Milani Spa regarding the purchase. After payment confirmation, the order cannot be canceled or modified. Orders can be placed in the following territories: Italian Republic, Republic of San Marino, Vatican City, Spain, Portugal, France, Belgium, Netherlands, Austria, Luxembourg. The language available for the conclusion of the sales contract is Italian.

5. ORDER RECEIPT CONFIRMATION AND ACCEPTANCE

Upon receiving an order, Milani Spa will automatically send a receipt confirmation via email, summarizing all the details of the order. Milani Spa reserves the right not to process purchase orders that are incomplete or incorrect or in the case of product unavailability. In these cases, Milani Spa will inform that the contract has not been concluded and that the purchase order has not been processed, specifying the reasons.

6. SHIPPING AND DELIVERY

Milani Spa will ship the products ordered by the Customer by courier to the address indicated by the Customer. Delivery will generally take place within 5 working days. The indicated delivery times are indicative. Shipments and deliveries of products can be made exclusively to the territories of the Italian Republic, San Marino, Vatican City, Spain, Portugal, France, Belgium, Netherlands, Austria, and Luxembourg. Milani Spa will ship purchased products exclusively to the destination specified in the order. No shipments to Post Office Boxes are accepted. For orders in Italy with an amount less than Euro 40.00, shipping costs are Euro 5.99, while for orders with an amount equal to or greater than Euro 40.00, delivery is free.
Shipping costs for other countries are as follows:

FRANCE – €20.00 for orders of any amount
SPAIN – €22.00 for orders of any amount
PORTUGAL – €23.00 for orders of any amount
BELGIUM – €20.00 for orders of any amount
NETHERLANDS – €20.00 for orders of any amount
AUSTRIA – €20.00 for orders of any amount LUXEMBOURG – €20.00 for orders of any amount

7. PAYMENTS

Milani Spa accepts payment only by: Credit card (American Express, Visa, or Mastercard); through the PayPal platform, an online payment system. Financial information (e.g., credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to the banks that provide the respective electronic distance payment services, without any third parties having access to it. This information will not be used by Milani Spa except to complete the procedures related to your purchase and to issue related refunds in case of any product returns following exercising your right of withdrawal.

8. INVOICING

An invoice will be issued for each order from a professional or a company with a VAT number that requests it. To issue the invoice, the information provided by the Customer at the time of the order is binding. No changes to the invoice will be possible after its issuance. When placing an order, it is necessary to indicate whether the shipping address is different from the billing address. If a private customer chooses not to enter their tax code, or a professional or company their VAT number, Milani Spa will not issue an invoice but only a fiscal receipt.

9. ACCEPTANCE OF THE PRODUCT BY THE CUSTOMER

Any damage to the packaging and/or the product, or the discrepancy in the number of packages or indications, must be immediately contested by specifying it on the delivery document. By signing the courier document, the Customer attests to the real exterior integrity of the product and the conformity of the delivery. Any issues regarding the actual physical integrity, correspondence, or completeness of the products received must be reported within 10 working days of delivery by sending an email to shop@caffemilani.it.

10. RIGHT OF WITHDRAWAL AND RULES FOR REPLACEMENT

The Customer has the option to return the purchased product and obtain a refund of the amount paid. The right of withdrawal can be exercised with the following methods: 1. Within the period of 14 working days from receiving the goods, the Customer sends a registered letter with acknowledgment of receipt to Milani Spa, Via Provinciale 811, 22030Lipomo (CO). The communication can also be sent, within the same period, by telegram or email to the address shop@caffemilani.it. 2. The return of the product must take place, at the customer’s expense and care, within 14 working days from the date of sending the withdrawal communication, to the following address: Lipomo, Via Provinciale 811 – 22030 (Como).
In case the Customer returns products beyond the aforementioned deadline or in the case of opened and/or partially used products that are not suitable for return, Milani Spa will contest the right of withdrawal and communicate that the products are available to the customer. With the above limitations, Milani Spa will refund the amount actually paid by the Customer within 14 working days from the receipt of the returned products through credit to the bank account or credit card indicated by the customer or by check. The refund of the price paid for the purchase of the product does not include return shipping costs.
